Enrollment and Eligibility By submitting an application to participate in The Purple Haze Affiliate Program ("Affiliate Program"), you agree to the terms and conditions outlined in this agreement. We reserve the right to reject any application at our sole discretion. If your application is accepted, you may participate as an affiliate of The Purple Haze ("Company"). This agreement is a legally binding document between you ("Affiliate") and The Purple Haze, and by joining the Affiliate Program, you confirm that you accept and will comply with all terms. 2. Payout Details Commission Rate: Affiliates will receive 20% commission on qualifying sales generated through their affiliate links. Exclusions: Commissions are not paid on shipping, taxes, or other additional fees. Referral Window (Cookie Period): The program uses a 30-day cookie, meaning affiliates will earn a commission if a referred customer makes a purchase within 30 days of clicking the affiliate link. Payment Schedule: Payments will be made 1 day(s) after actions are locked, which occurs 27 days after the end of the month they are tracked. Currency: All payouts will be made in USD. 3. Marketing and Promotion Guidelines Permitted Channels: Affiliates are encouraged to market and promote The Purple Haze products through their own websites, blogs, social media platforms, and other online marketing channels. Brand Representation: Affiliates may not represent themselves as employees, agents, or official partners of The Purple Haze. Affiliates are independent marketers of our products and must clearly indicate this in their promotions. Approved Usage of Content: Affiliates are authorized to use the marketing materials, banners, and content provided by The Purple Haze for promotional purposes. However, affiliates may not alter, modify, or create derivative works from the provided content without prior written permission from the company. Prohibited Actions: Affiliates are not allowed to engage in any misleading or unethical marketing practices, including but not limited to spamming, keyword bidding using company trademarks, or creating fake reviews. Affiliates must comply with FTC guidelines regarding affiliate disclosures. 4. Qualified Referrals Last Click Policy: The affiliate program uses a "Last Click" model for referral credit, meaning the last affiliate link clicked before a purchase will be credited with the sale. Cookie Duration: If a customer clicks on your affiliate link, you will earn a commission on any purchase made within the next 30 days, provided no other affiliate link was clicked after yours. 5. Reversal Policy The Company reserves the right to reverse or withhold commissions in the event of refunds, chargebacks, or fraudulent transactions. If any reversal occurs, the applicable commissions will be deducted from future payments. 6. Affiliate Obligations Compliance: Affiliates are responsible for ensuring that their website and promotional efforts comply with all local and international laws, including the FTC guidelines on affiliate disclosures. Non-Interference: Affiliates may not engage in any behavior that could redirect, interfere with, or tamper with customer transactions or links to the The Purple Haze website. This includes, but is not limited to, the use of unauthorized cookies, tracking pixels, or spyware. 7. Confidentiality Affiliates agree to treat any non-public information related to the affiliate program, including promotional events, as confidential. Affiliates must not disclose such information before its official release date or share it with third parties. 8. Termination Either party may terminate this agreement at any time by providing written notice to the other party. Upon termination, affiliates will no longer have access to their affiliate links or marketing materials. Any unpaid commissions for qualifying sales made prior to termination will still be paid according to the payout schedule. 9. Modification of Agreement The Purple Haze reserves the right to modify the terms and conditions of this agreement at any time. Affiliates will be notified of any changes, and continued participation in the affiliate program constitutes acceptance of the updated terms. 10. Limitation of Liability In no event shall The Purple Haze be liable for any indirect, incidental, or consequential damages arising from the affiliate’s participation in the affiliate program. The Company’s total liability shall not exceed the total commission paid to the affiliate in the past 12 months. 11. Governing Law This agreement will be governed by and construed in accordance with the laws of the state of Colorado. Any disputes arising from this agreement will be handled in the courts of Denver, Colorado.
